Three Shot Ouside High School
One suspect arrested after shooting outside high school
By: John Upton
06/15/09 3:03 PM PDT
SAN FRANCISCO — Three young people were treated for injuries today following an afternoon shooting outside a Potrero Hill high school.
A group of girls had just joined several boys at 1:20 p.m. outside International Studies Academy at 18th and De Haro streets, as summer classes were ending. Suddenly, five or six shots were fired into the crowd, according to witnesses.
The shots sounded like they were fired from a handgun, witnesses said.
After the shooting, teachers held the front doors of the school open while panicked students flooded inside, according to witnesses.
One suspect was arrested after the shooting and two guns were recovered, according to police spokeswoman Sgt. Lyn Tomioka.
The two male victims and one female victim were young, possibly juveniles, and they were all expected to survive injuries to the lower parts of their bodies, according to Tomioka.
The victim who sustained the most serious injuries was a male in his late teens who was shot in the foot and buttocks, according to Cheeko Wells, a member of the advocacy group Brothers Against Guns, who was inside the school at the time. The boy was wearing jeans and a white T-shirt, and it was the second time in two years that he had been shot, Wells said.
Trouble often brews when students from different schools attend summer session in an unfamiliar neighborhood, he said, as was the case today. “A lot of these kids are scared,” Wells said.
Also, a female student’s leg was grazed either by a bullet or a rock. She went home and alerted her father, according to San Francisco Unified School District spokeswoman Gentle Blythe.
Both male victims are not associated with the school or with the summer session, according to Blythe.
Summer school is scheduled to resume at the campus Tuesday, Blythe said.

Man Sentenced to Life in Prison For Murder of Social Worker
SF: MAN GETS 19 YEARS TO LIFE FOR 2005 MURDER OF SOCIAL SERVICES WORKER
SAN FRANCISCO (BCN)
A man who was fired from a San Francisco social and mental health services agency and returned to fatally shoot a case manager in 2005 was sentenced today to 19 years to life in prison.
Gregory Gray, 58, pleaded guilty in San Francisco Superior Court to second-degree murder on Feb. 26. He admitted shooting Conard House case manager Bruce Franks on May 9, 2005.
Members of Franks' family spoke at today's sentencing hearing, including his wife, Lisa Gershater Franks, who tearfully read a statement in court.
"I want to share my disgust and anger at Mr. Gray for choosing violence," she said. "As a long-time teacher in the Bayview, I spend a great deal of time teaching little ones to cope and to solve problems -- without violence."
Franks' family said he was committed to social justice, loved his family deeply, and strove to help some of the most marginalized residents of San Francisco.
"You sir, are a murderer and a thief," Gershater Franks told Gray. "You have stolen Bruce's remaining potential for helping others and improving his life and those of his son and daughter."
According to prosecutors, Gray, of San Francisco, was fired from Conard House about a year before the shooting, but was seen lurking near the agency that week.
On the morning of the killing, Gray came into the office where Franks, 49, was working alone, and during a struggle, shot Franks with a revolver, prosecutors said.
Another Conard House employee, Kalifa Coulibaly, arrived soon after and was ordered inside the office by Gray, who was now holding a shotgun.
Coulibaly and two passersby were able to disarm Gray until police arrived, but during the struggle, Coulibaly suffered a dislocated shoulder and fractured ankle. Additional shotgun and revolver ammunition were found at the scene.
Gray also pleaded guilty to battery with serious bodily injury for the injuries to Coulibaly.
"You have stolen your own potential for a better life," Gershater Franks told Gray. "Perhaps you felt hopeless, and did not know where to get help. I don't know why you did this terrible act, but I feel you will regret it for the rest of your life."

Gang Member Sentenced to 41 Years In Prison
Gang Member Gets 41 Years For Murder Of 7-Week-Old Infant, Two Teens
SAN FRANCISCO -- A former San Francisco drug gang member who had admitted to three murders including the slaying of a 7-week-old, was sentenced in federal court in the city Wednesday to 41 years and four months in prison for racketeering.
The sentence approved by U.S. District Judge William Alsup for Emil Fort, 27, was proposed in a plea bargain in March in which Fort pleaded guilty to one count of racketeering conspiracy.
The guilty plea ended a trial in which Fort could have faced a rare federal death penalty if he had been convicted of the murders of a 7-week-old baby and two teenagers in 2003 and 2004.
Fort admitted to the three fatal shootings during the guilty plea, but could have faced a death penalty only if he had been convicted of slayings as separate crimes of murder in aid of racketeering.
Fort was a member of the Down Below gang, which operated in the Sunnydale housing project in the Visitacion Valley neighborhood of the city. Prosecutors said the gang sold cocaine and other drugs and protected its turf with violence and murder.
Alsup had previously said he might not accept the sentence because it was too lenient.
But he announced today he had decided to approve it because prosecutors told him they might have had trouble proving that the murders were committed as part of a racketeering or gang enterprise rather than in a personal vendetta.
The judge said, "This is a compromise. At a minimum it will keep a very dangerous man off the streets for 41 years. There was a risk that might not have happened if we had gone all the way to verdict."
Fort was the last of 12 members of the gang who were indicted in 2005 to plead guilty to various charges.
He will get credit for nearly five years served in state and federal custody since July 2004.

Man Robbed After Stopping to Help Woman
SF: MAN FLAGGED DOWN BY DAMSEL IN DISTRESS, THEN ROBBED AT GUNPOINT
SAN FRANCISCO (BCN)
A Good Samaritan was robbed at gunpoint by a damsel in distress pretending to be injured in the street early this morning in San Francisco's lower Nob Hill neighborhood, police said.
At about 12:10 a.m., a 30-year-old San Francisco man driving in the 1500 block of Larkin Street saw a woman on her hands and knees in the street, stopped and got out to ask if she needed help, according to police.
The woman said she did need assistance, but when the man tried to help her up, she pushed him away and pointed a handgun at him, police said. She then went through the man's pockets, stole his cell phone, and took money from his wallet before throwing the wallet back at him and running off.
The victim gave chase, but the woman escaped down the block in car being driven by a second suspect.
About 10 minutes later, police spotted a woman matching the robber's description walking several blocks away on Larkin Street near Olive Street.
The victim was able to identify the alleged fraudster, 36-year-old Kimberly Brown, of San Francisco, and she was arrested.
Police weren't able to find the suspect vehicle -- described as a four-door, tan American car -- or the driver.
The gun and the victim's cell phone were also missing, but all the man's money was recovered, police said.
Brown was booked on suspicion of robbery and possession of stolen property.

Police to Increase Weekend Presence Around Nightclubs
Police hope to keep peace around city’s club venues
By: Tamara Barak Aparton
Examiner Staff Writer
04/23/09 7:58 PM
Police will fan out to nightclubs this weekend after a recent spike in violence outside SoMa and Mission district hot-spots.
“In the last three weeks, we have seen a weekend increase in violence,” police Sgt. Lyn Tomioka said. “We are redirecting some of our violence-reduction teams to be in the areas where we consider a potential [for violent crime].”
The department will pay overtime to deploy additional officers, she said.
“We’re going to have high visibility in the areas to deter criminal activities,” Tomioka said.
Among the most recent incidents was the shooting death of James Jamonte Turner, a 23-year-old Richmond man who may have left a SoMa club right before the incident. On Sunday, three men were hospitalized with stab wounds after a fight involving broken bottles outside SoMa’s The Endup.
Endup owner Sydney Leung said violence like Sunday’s fight is unusual, partly because of a constant police presence.
“We are literally one block away from Southern [Police] Station, so we’re pretty lucky. Normally, I do see [officers] during the night,” he said.
Leung said he welcomes additional patrols, especially as warm weather brings more revelers out.
Entertainment Commissioner Jim Meko said a visible police presence would be more effective than current legislation supported by club owners that would make it illegal to loiter outside for more than a few minutes.
“Ultimately, the solution is a police presence. Loitering law or no loitering law, we’ve found that foot patrols tend to make these things go away in an instant,” Meko said.
Commission Executive Director Bob Davis favors the patrols, but said the uptick in violence was not limited to clubs. There were three homicides last weekend, two of which were unrelated to clubs.
Police said next week they will re-evaluate whether to continue the increased patrols.

Woman Pleads Guilty To Accessory To Murder In Man's Death
SF: WOMAN PLEADS GUILTY AS AN ACCESSORY TO MURDER FOR 2008 BAYVIEW STABBING
SAN FRANCISCO (BCN)
A 23-year-old East Palo Alto woman pleaded guilty today in San Francisco Superior Court to an accessory to murder charge for her role in the stabbing death of a San Francisco father of three one year ago, prosecutors said.
Natasha McJimsey had been held in connection with the April 21, 2008, murder of Kenneth Arthur Jr., 46, who was found stabbed to death at about 12:30 a.m. at Thomas Avenue and Griffith Street, near his home in the Bayview district.
Arthur had been a celebrated recipient of the first Habitat for Humanity home in San Francisco.
Investigators believe his killing was over a drug debt Arthur had failed to pay to another man, 30-year-old David Earby Jr., of San Francisco.
According to investigators, McJimsey, a confessed crack dealer, knew Earby and that night at Earby's request, handed him the knife he used to kill Arthur, and later attempted to conceal evidence of the murder.
Earby was himself killed in an unrelated solo motorcycle crash in Pinole only days after the murder. McJimsey was arrested at her home on July 8.
McJimsey had been originally charged with murder, and today, prosecutors said she agreed to plead guilty to accessory to murder and drug charges.
Under the terms of the agreement, she faces three years and eight months in state prison, according to the district attorney's office.
Arthur became Habitat for Humanity San Francisco's first homeowner in the city in 1996. Five days before his murder, he emceed a Habitat for Humanity gala fundraiser and awards event attended by Mayor Gavin Newsom.
He left behind a wife and three sons.

Man Robs Financial District Bank
SF: POLICE LOOKING FOR BANK ROBBER WHO COMPLAINED ABOUT CORPORATE BAILOUTS
SAN FRANCISCO (BCN)
San Francisco police today asked for the public's help in finding a bank robbery suspect who reportedly told a bank manager he was angry about corporate bailouts.
The robbery took place at about 12:50 p.m. on April 15, at a Bank of America branch at 50 California St., according to police.
Police said the man initially asked to speak with a manager because he wanted to make "a large withdrawal."
When he met with the manager, the suspect, who was carrying a black laptop case, explained he worked for an organization concerned about government bailouts of corporations, according to police.
The man then allegedly threatened to detonate a bomb he was carrying with him if the manager didn't hand over cash.
The suspect smiled throughout the encounter, and told the manager the money "would go to people who deserve it," police said.
The manager never saw any explosive device, but gave the suspect a large amount of cash from the bank's vault, and the suspect fled on foot, police said.
Police spokeswoman Sgt. Lyn Tomioka said today that there haven't been any similar recent bank robberies in San Francisco.
Police described the suspect as a white man, about 6 feet tall and 190 pounds. He was last seen wearing a blue baseball cap with "SF" written on it, glasses, a khaki buttoned shirt and blue jeans.
Photos of the suspect are available at www.sfgov.org.

Shootings Kill 3 Over The Weekend
Police believe 3 shootings were impulsive acts

(04-20) 15:36 PDT SAN FRANCISCO -- Three young men killed in San Francisco since Friday apparently were victims of spontaneous gun violence, police said Monday.
"These aren't gang-related - these are people out with guns," said Lt. Mike Stasko of the San Francisco Police Department's homicide detail. "The victims don't have criminal records as far as we know."
The first victim, Norris Bennett, 21, wanted to make something of his life - his dream was to start his own business and run a group home.
To fulfill his dream, he was taking business classes at San Francisco City College while working part time teaching recreational activities at a senior housing complex in Daly City.
After finishing his shift Friday afternoon, Bennett went to his neighborhood near Griffith Street and Navy Road in Bayview-Hunters Point.
He was shooting dice with friends when someone shot him at 4:40 p.m., police said. He was pronounced dead at the scene.
"He was a real good kid," said Marcelia Blue, a manager at the senior complex where Bennett worked since January and a friend of his family. "He was bright, he had a future - he wanted to own a group home and help teens."
Although police say they need help solving the killing, Blue wasn't optimistic they would get it. "Somebody knows something," she said, "but nobody is going to say nothing."
Alexander Apalit of Daly City was shot about 9:15 p.m. Saturday at Otsego and Santa Ynez avenues in the Mission Terrace neighborhood near Balboa Park. He died at San Francisco General Hospital.
Like Bennett, Apalit was 21 and had a job, working as an automotive technician. He also had started a business with his cousins, running party buses.
Saturday night, Apalit was in a car with friends who were being chased by a sedan described as similar to an Infinity Q35, with five people inside, police said.
A person who was in the four-door sedan with tinted windows opened fire, hitting Apalit, who was in the backseat.
Police are unsure whether the gunman got out or fired from inside the car. They also do not know why Apalit and his friends were being chased.
Police said his friends drove Apalit to St. Luke's Hospital, where doctors tried to stabilize him. The hospital is not equipped to handle patients with gunshot wounds, so Apalit was taken by ambulance to San Francisco General, where he died.
Shortly after 2 a.m. Saturday, James Jamonte Turner, 23, of Richmond was shot at Third and Folsom streets in the South of Market.
Three men were seen fleeing the scene, police said. Turner was taken to San Francisco General, where he died.
Turner was apparently with friends at the time of the attack. He may have been the victim of a robbery or gotten into an argument on the street, possibly after going to a nightclub, Stasko said.
No arrests have been made in any of the killings, and police said they need the public's help to identify suspects. They ask that anyone with information call the homicide detail at (415) 553-1145.

Boy Killed In Visitacion Valley Shooting
Extra cops sent into S.F. project after slaying
John Koopman, Chronicle Staff Writer
Tuesday, April 14, 2009
(04-14) 12:26 PDT SAN FRANCISCO --
The San Francisco Police Department sent extra officers into the Sunnydale housing projects today following the shooting death of a 16-year-old boy late Monday.
Mark Crawford of San Francisco was shot about 10:15 p.m. on Blythedale Avenue near Hahn Street, about two blocks north of Geneva Avenue. He was pronounced dead at the scene.
Police spokesman Sgt. Wilfred Williams said Crawford was from the area but had recently moved away. He had come back for a visit when he was slain, Williams said.
No arrests have been reported in the slaying. Williams said it was unclear whether Crawford had any gang affiliations, or if there was another motive for the shooting.
There was little evidence of the shooting this morning, other than a wisp of yellow police tape floating in the breeze.
The neighborhood is poor, and there is significant drug and gang activity in the area. It is occasionally the scene of turf wars. The shooting occurred at the southern end of the housing projects.
Residents were reluctant to talk about the incident. A half-dozen police cars slowly cruised the area.
Officers said they knew little about the killing, but were on hand to try to prevent any further violence or retaliation.

Men Rob Excelsior District Bank
SF: ARMED MEN STORM EXCELSIOR DISTRICT BANK, PUNCH TELLERS, ESCAPE WITH CASH
SAN FRANCISCO (BCN)
Three armed men burst into a bank in San Francisco's Excelsior District Friday afternoon and punched two tellers before escaping with an undisclosed sum of money, authorities said today.
According to San Francisco police spokeswoman Sgt. Lyn Tomioka, three men wearing masks and gloves, and armed with handguns, entered the Sterling Bank & Trust at 4627 Mission St. at about 3:45 p.m. and demanded money.
Two bank tellers were punched before the men took the money and fled, according to police.
Tomioka said one of the tellers was treated at a hospital.
The Police Department's initial investigation led them several blocks away to the 100 block of Florentine Street near the city's southern border, but no arrests were made.
"It doesn't appear that was where anybody lived, but that's just where the first phase of the investigation led," she said.
The incident was San Francisco's first takeover robbery this year, FBI spokesman Joe Schadler said, adding that overall bank robberies in the city are down this year from last. The FBI is assisting San Francisco police in this investigation.
"Takeovers, for a big city like San Francisco, they really are very, very rare," said Tomioka.

Family Sues City Over Excelsior Triple Homicide
Family Sues SF Over Triple Killing Of Father, Sons
SAN FRANCISCO (BCN) ―
Attorneys for the surviving family members of a father and two sons fatally shot in San Francisco's Excelsior district in 2008 have filed a lawsuit against the city, alleging its sanctuary policy contributed to their deaths.
Edwin Ramos, a 22-year-old suspected member of the MS-13 street gang, is being held without bail for allegedly fatally shooting Anthony "Tony" Bologna, 48, and his sons Michael, 20, and Matthew, 16, on June 22.
The three were found shot inside their car. Police have said they may have been mistaken for rival gang members.
In a lawsuit filed Friday in San Francisco Superior Court, the Bologna family alleges the city's "illegal sanctuary policies were a substantial factor" in the killings.
The lawsuit claims Ramos was in the country illegally, had a history of violence and several prior contacts with San Francisco police as a minor, but the sanctuary policy kept police and juvenile probation officers from reporting him to federal immigration authorities for deportation.
"What we're saying is that the city adopted and enforced a policy that was actually inconsistent with and prohibited by federal law," Michael Kelly, an attorney for the Bologna family, said Tuesday.
Kelly said if the case goes to trial, a jury would decide to what extent the city was responsible for the deaths.
The city attorney's office declined to comment on the case. A statement from Mayor Gavin Newsom's office also declined to address the case specifically.
"I am deeply sympathetic to the Bologna family's devastating loss," said Newsom in the statement. "A terrible crime was committed and my heart goes out to the family."
Ramos faces three counts of murder and multiple special allegations involving gang membership, firearm use and multiple murders that could result in life in prison without parole, and is still awaiting trial.
A preliminary hearing in the criminal case is scheduled for May.

3 Women Sentenced In Robbery And Murder of Russian Immigrant
3 women get prison in slaying of immigrant
Jaxon Van Derbeken, Chronicle Staff Writer
Saturday, April 4, 2009
A San Francisco judge sentenced three women to prison terms ranging from eight years to 21 years Friday in the slaying of a Russian immigrant they had lured to an isolated area, robbed and shot in the head.
Kimberly Gutierrez, 21, who prosecutors said pulled the trigger, was sentenced to 21 years in prison in the death of Eugene Gorenman, 26, of San Francisco, who was found dead near a gun battery at Fort Funston on March 29, 2004.
Guiterrez was 16 at the time but was charged as an adult with murder. She entered a guilty plea to voluntary manslaughter as part of a settlement in the case. She could have faced 25 years to life if convicted of murder.
Felicia Mehrara, 21, was also a juvenile at the time of the killing but was also charged as an adult. She was sentenced to eight years in prison for voluntary manslaughter by Judge Jerome Benson.
A third defendant, Jillian McIlvenna, 24, was sentenced to 11 years in prison.
Police homicide investigators traced the use of one of Gorenman's credit cards to McIlvenna.
Gorenman was a Russian immigrant who grew up in Walnut Creek, graduated from UC Berkeley and worked as a computer engineer with Pacific Gas and Electric Co.
In a statement to the court, Gorenman's parents called the defendants "human filth" and "vicious savages."
"For a mere 20 dollars he was murdered without the slightest regard for his life, promise of future, his family and friends," they said.

Man To Stand Trial For 2007 Murder, Sexual Assaults
SF: MAN ACCUSED OF FATALLY STABBING GIRLFRIEND IN 2007 TO STAND TRIAL
SAN FRANCISCO (BCN)
A San Francisco Superior Court judge ruled Wednesday that a 32-year-old man accused of stabbing his girlfriend to death in 2007 should stand trial for murder.
Umar Hudson, of San Francisco, is also accused of sexually assaulting the two young daughters of the girlfriend, 32-year-old Jernell Scott, in 2006 and 2007.
One of the daughters reported the alleged crimes in February 2007. On April 6 of that year, Hudson allegedly stabbed Scott 39 times, prosecutors said.
The stabbing happened in the 900 block of Ellsworth Street, according to police. Hudson was arrested later that night.

Police Interrupt Suspected Gang Initiation
SF: POLICE INTERRUPT SUSPECTED NORTENO GANG INITIATION, ARREST ONE
SAN FRANCISCO (BCN)
San Francisco police officers on Friday broke up an apparent gang initiation ceremony in the Mission district, police said today.
Plainclothes officers interrupted about 30 people, including suspected Norteno gang members, who were gathered shortly after midnight Friday in the middle of Utah Street near 25th Street, according to police.
The area is just east of the city's gang injunction area against the Nortenos, which extends west from Potrero Avenue.
A scuffle broke out in the crowd, indicating to police a common Norteno gang initiation in which an aspiring gang member is "jumped."
Officers then detained nine people, including the alleged initiate, an 18-year-old San Francisco man who suffered a cut nose and a swollen eye, police said.
Jeffrey Almengor, 19, of San Francisco, was booked for possession of a firearm allegedly found in his car, which was parked nearby, according to police.

Man Pleads Guilty To Robbing Nine banks
SF: MAN PLEADS GUILTY TO UNARMED ROBBERIES OF NINE BANKS IN THE CITY
SAN FRANCISCO (BCN)
A San Francisco man pleaded guilty in federal court in San Francisco today to the unarmed robbery of nine banks in the city between November 2007 and March 2008.
James Burge, 52, entered the guilty plea before U.S. District Judge Marilyn Patel in San Francisco.
He will be sentenced by Patel on June 29. Burge faces a theoretical maximum sentence of 20 years for each count, but the actual penalty will be determined after consideration of federal sentencing guidelines.
U.S. Attorney Joseph Russoniello said Burge was unarmed during the robberies, but gave tellers notes saying he had a gun.
Burge was initially charged in a criminal complaint in March 2008 with two bank robberies, but an indictment in November expanded the number to nine.
An FBI affidavit filed with the complaint in March 2008 stated that Burge confessed the robberies to police after giving up his right to a lawyer. Burge said he robbed the banks to support a heroin habit, the affidavit said.
The banks included branches of Trans Pacific National Bank, Bank of the West, Wells Fargo Bank, Bank of America and U.S. Bank, according to the indictment.
Russoniello said Burge pleaded guilty to all nine counts without a plea agreement.

Man Shot In the Tenderloin, Boy Shot In Bernal Heights
One arrested, one hospitalized, following shooting in Tenderloin
By Will Reisman
Examiner Staff Writer 3/3/09
SAN FRANCISCO – A man was hospitalized last night with life-threatening injuries after he was shot in the Tenderloin neighborhood by a suspect who was later arrested.
The two men were seen engaging in a physical altercation at the corner of Ellis and Jones streets when officers intervened at about 7:50 p.m. on Monday, according to Sgt. Lyn Tomioka of the San Francisco Police Department.
By the time police broke up the fracas, they realized that one of the men had been shot, Tomioka said. They arrested the other man, who was found to have a firearm on his possession. His identity has not been released yet.
Following the shooting, the victim was walking around and talking to officers, but his health suddenly took a turn for the worse, and he was transported to San Francisco General Hospital with life-threatening injuries, Tomioka said.
Tomioka said investigators are trying to determine what caused the altercation.
On February 23, a woman was killed in a drive-by shooting at Turk and Taylor streets, three blocks from where the two men were seen fighting last night. No arrests have been made in the death of Laticia Hunter, a 33-year-old Sacramento native.
Also on Monday night, one youth was hospitalized with non life-threatening injuries after being shot near the Bernal Heights neighborhood.
The boy, whose name has not been released, was walking with three of his friends on the 100 block of Highland Avenue, when an unidentified suspect got out of a car and opened fire on the group, police said.
The boy was transferred to a nearby hospital and is expected to make a full recovery, police said. No one has been arrested and the case is under investigation.

Police said residents in the Outer Mission heard shots fired at about 8:30 a.m. Responding officers found the victim, identified only as a Hispanic male, lying wounded in the 5300 block of Mission Street. Seven hours later, police were called to the Hippy Hill area of Golden Gate Park, where they found a park visitor suffering life-threatening stab wounds. The victim was rushed to San Francisco General Hospital.
The stabbing was followed by two nonfatal shootings in the Mission District, and two more knifings in the Tenderloin.
On Saturday, two people were shot at the corner of 19th and Capp Streets just after 8 p.m. They were rushed to the hospital and are expected to survive, police said. No arrests were made. Twenty minutes later, a nonfatal stabbing occurred at the corner of Eddy and Taylor streets in the Tenderloin.

SFPD Asks For Help In 2008 Homicide
S.F. police seek help in probe of 2008 killing
Jaxon Van Derbeken, Chronicle Staff Writer
Friday, February 20, 2009
(02-19) 14:25 PST SAN FRANCISCO -- San Francisco police are asking for the public's help as they investigate the shooting death of a man last March that the medical examiner recently determined was a homicide.
Jimy Reyes-Navas, 21, of San Francisco was found just before 4 a.m. on March 2, bleeding on the sidewalk in the 1900 block of Palou Avenue in the Bayview district. A handgun was at his side.
Reyes-Navas never regained consciousness and died six days later.
Last month, the medical examiner's office ruled the death a homicide, based on its conclusion that Reyes-Navas had given no indication he was suicidal and had no access to a gun. It also said his DNA had not been found on the gun handle.
The only witness on the street told police that he had heard the gunshot but hadn't been looking in the direction from which it came. The witness said that when he turned around, Reyes-Navas was lying on the sidewalk and no one was around.
Police said Reyes-Navas did not appear to have been robbed.
He was a day laborer from Honduras who had not worked for six weeks, investigators said. Reyes-Navas had been staying with his brother on Palou, and went out about an hour before the shooting after a night of drinking beer.
"I'd really like to get to the bottom of this - we have a couple of witnesses who heard but didn't see anything, but we need people to come forward if they did see anything and to contact us at the homicide detail," said police Lt. Mike Stasko.
Homicide investigators can be reached at (415) 553-1145.

1 Dead, 5 Injured In Tenderloin Drive-By Shooting
1 dead, 5 wounded in S.F. Tenderloin shooting
By TERRY COLLINS, Associated Press Writer
Tuesday, February 24, 2009
(02-24) 16:59 PST San Francisco, CA (AP) --
Police say they hope surveillance cameras will provide clues into a late night drive-by shooting Monday that left one woman dead and five other people wounded in the tough Tenderloin district.
The slain woman was identified as Leticia Hunter, 33, of Sacramento by the coroner's office. No arrests have been made .
Someone riding in a silver-colored Mercedes Benz SUV opened fire on a busy street corner, Police Sgt. Lyn Tomioka said Tuesday.
After the shooting, police chased a sports-utility vehicle across the Bay Bridge toward Oakland at speeds of more than 110 mph speed but they could not catch it.
Early Tuesday, Oakland police recovered a burned-out vehicle matching the description of the SUV involved in the shooting. Tomioka said it was unknown whether the vehicle had been stolen.
The wounded were hospitalized with what Tomioka called non life-threatening injuries.
It is not known whether the victims were bystanders or targets.
Investigators are interviewing witnesses, and they plan to review footage from surveillance cameras posted in the historic, yet crime-riddled neighborhood to look for leads in the shooting, Tomioka said.

Man Stabbed To Death In The Tenderloin
Surveillance video leads S.F. police to suspect in stabbing death
Henry K. Lee,Jaxon Van Derbeken, Chronicle Staff Writers
(01-15) 12:46 PST SAN FRANCISCO -- Footage from store surveillance cameras led San Francisco police to a suspect in the stabbing death of a man on a Tenderloin street, police said today.
The two men began fighting shortly before 5:30 p.m. Wednesday on Turk Street near Jones Street, and one of them stabbed the other.
The victim, identified as Darnell Curry, 31, crossed Jones Street to where an ambulance was parked for an unrelated call, police said. He was taken to San Francisco General Hospital, where he was pronounced dead.
In reviewing surveillance video from a cell-phone store and a Salvation Army outlet, police saw the stabbing and the assailant running away, investigators said. Plainclothes officers found a man with a bloody knife who matched the attacker's description, police said.
Inspector Dennis Maffei said the man who was arrested, Tommy Thomas, 63, has an extensive criminal history.
"He claimed it was self-defense," Maffei said. "But his history is very long, very violent, including a couple of attempted murders and some violent sexual offenses."
Thomas was pushing wheelchair at the time of the fight, Maffei said.
"There was a lot of back-and-forth stuff," the inspector said. "The victim grabbed a plastic advertising frame and threw it at the suspect. He was stabbed shortly after that."
