Jaywalking Man Punched By Angry Driver

Punch leaves pedestrian clinging to life

SAN FRANCISCO – A 53-year-old pedestrian was fighting for his life Thursday after an altercation with a motorist near Golden Gate Park the previous evening.

Police say the man was crossing Hayes and Stanyan streets against a red light just after 5 p.m. when a motorist honked at him.

In response, the pedestrian slammed his backpack on the hood of the vehicle. The driver got out of the car and punched the pedestrian, who fell to the ground and hit his head.

He remains hospitalized with a serious head injury. No arrests have been made in the case.

On March 20, 2007, a pedestrian punching a vehicle led to a homicide when enraged driver Hamilton Diaz allegedly ran down 24-year-old Randal Gross after either Gross or his companion punched the parolee’s car in the intersection of 15th and Valencia streets.

sounds like both people are guilty of something. The driver is guilty of assault. The jaywalker is guilty of being a moron.

Honestly, I'm surprised this kind of thing doesn't happen more often...pedestrians think they own the streets - and I am a pedestrian myself!

I have to side with the driver here. That pedestrian shouldn't have been jaywalking in the first place, and he certainly had no right to assault the driver's car.

The law says pedestrians must not stop or otherwise delay crossing the street once they start, so even if the pedestrian were crossing on a green, it would have been illegal for them to stop in the middle of the street to yell at a driver who honked at them.

There is no law against a car driving through a crosswalk with a pedestrian in it, so long as that does not put the pedestrian in danger. I.e., if you let the pedestrian pass in front of you and they're well out of the way, it's legal to make the right turn or whatever.

Both people in this case are just idiots, though... if the driver hadn't seen the pedestrian and had hit him, he probably wouldn't have been at fault. Stopping the car and clocking him? Different story.
